Terms and Conditions for Broligans, LLC Indoor Golf Simulation Studio

1. Acceptance of Terms
   
   By accessing and using the indoor golf simulation facilities provided by Broligans, LLC ("Broligans"), you ("the Customer," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Broligans, LLC, located in Brock, Texas. If you do not agree to these Terms, you are not authorized to access or use Broligans.

2. Access to Facilities
   
   Membership or Booking Required: Access to Broligans is granted to individuals with a valid and active membership with Broligans, LLC, or through a pre-booked session made via the Your Golf Booking platform.
   
   You must be 18 years or older to book a bay or sign up for a membership. You will be required to provide your Drivers License for proof of age. All minors are expected to be accompanied by a legal adult or guardian.
   
   24/7 Member Access: Subject to booking availability and these Terms, members with appropriate access privileges may access Broligans 24 hours a day, 7 days a week using their provided access credentials (e.g., keycard, mobile app access).
   
   General Public Access: The general public may access Broligans by booking and paying for individual sessions through the Your Golf Booking online platform, subject to availability and scheduled hours for non-members as posted on the booking platform.
   
   Personal Access Only: Your membership and access credentials (if applicable) are personal to you and are non-transferable. You are responsible for maintaining the security and confidentiality of your access credentials. Sharing your credentials with others is strictly prohibited and may result in the termination of your membership without refund.
   
   Booking System: All simulator usage, whether for members or the general public, must be booked in advance through the Your Golf Booking online platform. Bookings are subject to availability and any time slot restrictions outlined on the booking platform.
   
   Access Code: Approximately 15 minutes before your scheduled booking time, you will receive a unique 4-digit code to gain access to the Broligans building. This code is time-sensitive and intended for use only during your booked session.
   
   Cancellation Policy: Cancellations made 24 hours prior to the booking will result in a booking credit issued to your account. Cancellations made within 24 hours of the booking will not be eligible for a booking credit. No refunds will be provided for cancellations.
   
   Studio Monitoring: For security and operational purposes, Broligans is equipped with video surveillance. By entering Broligans, you consent to being recorded.

3. Use of Facilities and Equipment
   
   Proper Use of Simulators (Trackman): Broligans utilizes Trackman golf simulation software. You agree to use the Trackman simulators and all other equipment owned by Broligans, LLC in a safe and responsible manner and only for their intended purpose. Instructions for operating the Trackman simulators will be available on the simulator interface. Please familiarize yourself with these instructions before use.
   
   Respect for Equipment: You are responsible for any damage to the simulators (including Trackman sensors and software), screens, projectors, hitting mats, golf clubs (if provided by Broligans, LLC), or any other property of Broligans, LLC caused by your negligence, misuse, or intentional actions. You will be responsible for the cost of repair or replacement of any damaged equipment belonging to Broligans, LLC.
   
   Responsibility for Damage: The individual who made the booking is responsible for any and all damage to the Broligans facility caused by themselves or their guests during their booked session. This includes the cost of all necessary repairs. Furthermore, if such damage results in a loss of business for Broligans, LLC, the booking individual may be held liable for those losses.
   
   Personal Belongings: Broligans, LLC is not responsible for any loss, theft, or damage to your personal belongings brought into Broligans. You are solely responsible for the security of your items.
   
   Cleanliness: You are expected to leave the simulation bay and any common areas you use in a clean and tidy condition after your session at Broligans. Please dispose of any trash in the designated receptacles.
   
   Food and Drink Purchases: Food and drinks are available for purchase within Broligans. You and your guests will be charged for any food or drinks taken without payment.
   
   Merchandise Purchases: Broligans and HYPER clothing, accessories, and golf equipment are available for purchase within Broligans. You and your guests will be charged for any merchandise taken without payment.
   
   No Smoking or Illegal Substances: Smoking (including vaping) and the use of illegal substances are strictly prohibited within the premises of Broligans.
   
   Appropriate Conduct: You agree to conduct yourself in a respectful and considerate manner towards other users (if present) and the property of Broligans, LLC. Disruptive or inappropriate behavior is not permitted.

4. Safety and Liability
   
   Assumption of Risk: You acknowledge that using golf simulators (including Trackman technology) and being in an unmanned facility owned and operated by Broligans, LLC involves certain inherent risks, including but not limited to: slips, trips, falls, and injury from swinging golf clubs or hitting golf balls. You voluntarily assume all such risks associated with accessing and using Broligans.
   
   No On-Site Supervision: You understand and acknowledge that Broligans is an unmanned facility and there will be no on-site staff present during your access. You are solely responsible for your safety and well-being while in Broligans.
   
   Emergency Procedures: You are responsible for familiarizing yourself with any posted emergency procedures within Broligans, including the location of emergency exits and any available emergency contact information. In the event of an emergency, you should contact the appropriate authorities directly.
   
   Limitation of Liability: To the maximum extent permitted by law, Broligans, LLC, its owners, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including, without limitation, personal injury, property damage, or loss of profits) arising out of or in any way connected with your access to or use of Broligans, even if Broligans, LLC has been advised of the possibility of such damages.
   
   Indemnification: You agree to indemnify, defend, and hold harmless Broligans, LLC, its owners, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms, your misuse of the Broligans facilities or equipment owned by Broligans, LLC (including the Trackman simulators), or your negligence or willful misconduct, including any damage caused by your guests.

5. Membership and Payment (If Applicable)
   
   Membership Fees: Membership fees for Broligans, LLC are as outlined on our website or membership agreement and are subject to change.
   
   Payment Terms: Members agree to pay all applicable membership fees and charges to Broligans, LLC according to the payment schedule they selected. General public users will pay for their sessions through the Your Golf Booking platform at the time of booking.
   
   Billing: For members, by providing your payment information to Broligans, LLC, you authorize Broligans, LLC to charge your chosen payment method for all applicable fees. Payment for general public bookings will be processed by Your Golf Booking according to their terms and conditions.
   
   Renewal and Termination: Membership renewal and termination policies with Broligans, LLC are as outlined in your membership agreement or on our website.
   
   Price Changes: Broligans, LLC reserves the right to modify membership fees and other charges upon reasonable notice. Session prices for the general public are subject to change as posted on the Your Golf Booking platform.

6. Intellectual Property
   
   All content, trademarks, logos, and other intellectual property displayed within Broligans or on our website are the property of Broligans, LLC or its licensors (including, but not limited to, Trackman and Your Golf Booking) and are protected by applicable intellectual property laws. You are not permitted to use any of this intellectual property without our prior written consent from Broligans, LLC or the respective owner.

7. Governing Law and Dispute Resolution
   
   These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of Broligans shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas.

8. Amendments to Terms
   
   Broligans, LLC reserves the right to modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting the revised Terms on our website or within Broligans. Your continued use of Broligans after the posting of revised Terms constitutes your acceptance of the changes. It is your responsibility to review these Terms periodically for any updates.

10. Entire Agreement
    
    These Terms constitute the entire agreement between you and Broligans, LLC with respect to your access to and use of Broligans and supersede all prior or contemporaneous communications and proposals, whether oral or written.
    
    By proceeding to book a session or purchase a membership through Your Golf Booking or otherwise accessing the facilities of Broligans, LLC, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
